Terms & Conditions of Service
1. Acceptance of Terms
By accessing or using the Heredita website and its digital map-based gaming platform, you agree to be legally bound by these Terms of Service. Agreement is finalized through a clear affirmative action, such as clicking a checkbox during account creation. If you do not agree to these terms, you are not authorized to use the service.
2. Eligibility and Parental Consent
2.1. Minimum Age
You may only use the Service if you meet the minimum age of digital consent in your jurisdiction. This is generally 16 years of age in the European Union and European Economic Area under the General Data Protection Regulation (GDPR), unless a lower age (not below 13) is permitted by local law. In other jurisdictions, including the United States, the minimum age is 13 years.
2.2. Minors
If you are under the age of 16 (or the applicable digital consent age in your jurisdiction), you may only use the Service with verifiable parental or guardian consent. In the United States, users under 13 may not use the Service unless verifiable parental consent is obtained in compliance with the Children's Online Privacy Protection Act (COPPA). If such consent cannot be verified, we do not knowingly collect or process personal data from users under 13.
3. Account Registration and Data Collection
To provide the Heredita service, we collect and process specific information you provide during registration:
3.1. Information Collected
Username, email address, date of birth, and authentication data (passwords, which are stored in an encrypted/hashed format).
3.2. Purpose
This data is used for account creation, ensuring platform security, and maintaining gameplay functionality.
3.3. Account Responsibility
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
4. Intellectual Property and Ownership
Heredita grants you a limited, non-exclusive, and non-transferable license to use the website for personal entertainment purposes only.
4.1. User Ownership of Maps
Any digital maps created or submitted by you on the platform remain your intellectual property.
4.2. Non-Exclusive License to Heredita
By creating or submitting a map, you grant Heredita a non-exclusive, worldwide, royalty-free, and sub-licensable license to host, display, distribute, and use such content solely for the purpose of operating and improving the gaming service.
4.3. Operational Necessity
This license is required so that other players can interact with your maps and so the platform can process the data as part of the game's core functionality.
5. Prohibited Conduct (Code of Conduct)
To maintain a safe community, you agree not to engage in the following prohibited behaviors:
5.1. Harassment and Hate Speech
You may not threaten, abuse, or share hateful or harmful content directed at others.
5.2. Doxxing
You are strictly prohibited from disclosing the personal data of other users without their consent.
5.3. Cheating and Exploitation
You may not use exploits, manipulate game systems, or engage in cheating.
5.4. Integrity of Service
You may not engage in scraping, reverse engineering, or any activity that disrupts the platform's integrity.
6. User Rights Regarding Information
In accordance with global data protection standards (such as GDPR), you have the following rights regarding the information you provide:
6.1. Access and Correction
The right to view and correct your personal data.
6.2. Erasure
The right to request the deletion of your data (the "right to be forgotten").
6.3. Withdrawal of Consent
You may withdraw your consent at any time by deleting your account.
7. Virtual Currency and In-Game Store
Heredita features a website store where users can acquire Virtual Currency to purchase digital items, assets, or memberships (subscriptions).
7.1. Transactions
Users may use the platform to buy and sell digital items within the game's ecosystem using Virtual Currency.
7.2. Ownership of Virtual Items
You own the virtual items and assets you purchased or acquired on the platform. However, this ownership is limited to the Heredita ecosystem and does not grant you any right to use these items outside of the service.
7.3. No Real-World Value
Virtual Currency and items have no real-world monetary value. They cannot be redeemed for fiat currency, "real" money, or any other items of value from Heredita or any third party.
8. Refund Policy
At Heredita, we strive to provide a fair and transparent experience. While virtual items and currency have no real-world monetary value, we offer a conditional refund policy for purchases made through the Heredita store.
8.1. Refund Eligibility
You may request a refund for a purchase within 14 days (two weeks) of the transaction date, provided the following conditions are met:
- Virtual Currency: Refunds for Virtual Currency are only available if the currency remains unspent. A refund will be denied if processing it would result in your account having a negative balance of that currency.
8.2. Non-Cosmetic Items
For any in-game items, assets, or features that are not purely cosmetic (e.g., functional gameplay tools or map enhancements), you must have used the item for less than two (2) hours of total gameplay or active time to be eligible for a refund.
8.3. Subscriptions and Memberships
Recurring subscriptions (memberships) are generally non-refundable once the billing period has begun, as access to the service is provided immediately upon payment. However, you may cancel at any time to prevent future charges.
8.4. Exceptional Cases
In exceptional cases, the Heredita team may, at its sole discretion, issue a refund outside of the conditions set out above. This shall not be interpreted as creating any entitlement to a refund; any such refund may be granted solely at the discretion of the Heredita team.
8.5. Requesting a Refund
Users must contact the official Heredita support channel within the 14-day window to initiate a request. All refunds are issued to the original payment method where possible.
9. Account Termination and Forfeiture
While we provide this refund policy to maintain a positive community relationship, it does not waive our right to enforce platform rules:
9.1. Violations
If your account is terminated or banned for prohibited conduct (including harassment, doxxing, or cheating), you forfeit all rights to request refunds for any Virtual Currency, items, or active subscriptions.
9.2. Finality Upon Ban
Following a lawful termination for a breach of these Terms, there is no way to reclaim or receive a refund for any lost assets.
10. Security and Data Breaches
Heredita implements technical and organizational safeguards, including encryption and access controls, to protect your data. In the event of a high-risk security breach, we will notify affected users as required by law.
11. Termination of Service
We reserve the right to suspend or terminate your access to Heredita at any time if you violate these terms or if required for legal compliance.
12. Limitation of Liability and Disclaimer
Heredita is provided on an "as is" and "as available" basis without warranties of any kind. To the maximum extent permitted by law, Heredita is not liable for any indirect, incidental, or consequential damages arising from your use of the website.
13. Governing Law
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to conflict of law principles.
Under the GDPR, for "information society services" (digital content), the right of withdrawal can be waived if the user gives express consent to begin the service immediately and acknowledges they lose their right to cancel. The checkbox at checkout should include a small note saying: "By clicking 'Buy', you agree to immediate access to this content and acknowledge our 14-day / 2-hour refund policy."
